Validity of the GTC 

(1) These General Terms and Conditions apply to contracts for the rental provision of holiday apartments for accommodation, as well as all other services and deliveries provided by Appartamento Marc for the guest. Appartamento Marc's services are exclusively based on these General Terms and Conditions. (2) Subletting or further renting of the provided holiday apartment and its use for purposes other than residential require our prior written consent. (3) Guest terms and conditions apply only if agreed upon in advance. Deviations from these conditions are only effective if explicitly confirmed in writing by us. 


§ 1 Definitions 

a) The term "Appartmento via Napoli," "we," "us," or "our" refers to Appartamento Marc, a private individual registered with the registration office of Regione Puglia under identification number CIS: BA07200691000042736 as the landlord of the holiday apartment. b) The term "Appartamento Marc" refers to our website appartamentomarc.smoobu.net. c) The term "Services" refers to all services provided by Appartamento Marc, including, but not limited to, receiving booking information through our booking and payment system, managing reservations and payments, and responding to customer inquiries through our reservation system and managing content on third-party channels through our channel manager. d) The term "Customer" refers to either: a) the person registering for a customer account in their own name, or b) the organization for which the person registers for a customer account on behalf of an organization. e) The term "Customer Account" refers to the account created by the customer on appartamentomarc.smoobu.net to access and use the services. f) The term "Property" refers to any form of accommodation, building, houseboat, apartment, room, housing block, houses, or other living spaces or rental areas displayed by the customer or a third-party channel and offered for rent through the services. g) The term "Content" means text, graphics, images, music, software, audio, video, information, or any other form of data. h) The term "Customer Content" refers to content provided by the customer in the course of using the services, including but not limited to other information. 


§ 2 Booking/Booking Confirmation 

All booking inquiries must be made through our website appartamentomarc.smoobu.net or via email at vianapolibari@gmail.com. Requests made through any other method, such as social media channels, will not be considered. If we can offer you the holiday apartment for your desired period, we will send you a written confirmation and invoice by email. Upon receipt of the booking confirmation and after the payment of the deposit (see § 3 Payment Conditions), your booking becomes legally binding.


§ 3 Payment Conditions 

Your booking becomes valid upon receipt of the deposit. The full payment of the rental agreement is due within 7 days after receiving the booking confirmation. Failure to meet payment deadlines may result in Appartamento Marc canceling the contract. Non-payment is considered as cancellation and fees for processing and cancellation, corresponding to the deposit amount, will be charged. Additional costs for water, energy and waste are not levied. Only a cleaning fee and the mandatory tourist tax in the region are payable.


§ 4 Check-In and Check-Out 

On the arrival day, the holiday apartment is available from [3:00 PM]. The information for key handover will be provided to the guest [1 day] before arrival via email. Claims for damages cannot be asserted if the holiday apartment cannot be occupied exceptionally at [3:00 PM]. On the departure day, the apartment must be vacated by [10:00 AM]. Late departure without agreement will be invoiced, refer to the house rules for details. If the guest does not appear on the arrival day, the contract is considered terminated after a 48-hour period without notification to Appartamento Marc. Appartamento Marc or our representative can then freely dispose of the property. Refund of the rental price is excluded. (Partial) reimbursement of rent due to early departure is generally not provided. The apartment must be left swept clean on the departure day. Dishes, glasses, etc., are to be cleaned and put away, trash emptied, and the refrigerator cleared. If the apartment is not left as desired, charges may apply. 


§ 5 Holiday Apartments 

The holiday apartment is handed over by us in a tidy and clean condition with complete inventory. If any defects are noticed during your stay, the guest is obligated to inform Appartamento Marc immediately. The guest is liable for damages caused to the rental property, inventory (e.g., broken dishes), damages to the floor, or furniture. This includes the cost of lost keys. The inventory is to be treated with care and only intended for use within the holiday apartments. Moving furniture, especially beds, is prohibited. The guest is also responsible for the actions of accompanying persons. Damages due to force majeure are excluded. In the case of improper use of the holiday apartment, such as subletting, overoccupation, disturbance of peace, etc., the contract can be terminated immediately, and the guest must vacate the holiday apartment. The already paid rent remains with Appartamento Marc. 


§ 6 Pets 

The accommodation of pets of any kind is prohibited. Owners of assistance animals must contact Appartamento Marc before booking. If animals are accommodated despite the ban, a cleaning fee of up to 300 euros may be charged. 


§ 7 Stay 

The holiday apartment may only be used by persons listed in the booking. If the apartment is used by more persons than agreed, a separate fee of 10 euros per night is to be paid for each additional person. In this case, Appartamento Marc also has the right to terminate the contract immediately. Subletting and transferring the apartment to third parties are not allowed. The guest agrees to the General Terms and Conditions and the house rules of the holiday apartments. The agreement is made with the payment. In case of violations of the GTCs or house rules, Appartamento Marc is entitled to terminate the rental immediately and without notice. There is no legal claim for a refund of the rent or compensation. 


§ 8 Cancellation by the Guest 

In case of cancellation, the guest is obliged to pay part of the agreed price as compensation. Cancellation must be made in writing. The amount of compensation depends on the time until the arrival day and is as follows: up to 24 hours after booking, the apartment can be canceled free of charge. Up to 30 days before the arrival day 50% of the agreed price. Less than 30 days before the arrival day or in case of non-arrival, 100% of the agreed price. 


§ 9 Cancellation by the Landlord 

In the event of a cancellation by us due to force majeure or other unforeseeable circumstances (such as accidents or illnesses of the hosts), which make fulfillment impossible; liability is limited to the refund of costs. In the case of a justified cancellation, there is no customer claim for damages—no liability for travel and hotel costs. Cancellation by Appartamento Marc can occur after the start of the rental without observing a deadline. 


§ 10 Landlord's Liability 

Appartamento Marc is liable within the scope of due care for the proper provision of the rental property. Liability for possible failures or disruptions in water or electricity supply, as well as events and consequences of force majeure, is hereby excluded. 


§ 11 Permission to Use Internet Access via WLAN 

Appartamento Marc maintains an internet connection via WLAN in its holiday apartment. It allows the guest to share the WLAN access for internet use during their stay in the holiday property. The tenant does not have the right to allow third parties to use the WLAN. Appartamento Marc does not guarantee the actual availability, suitability, or reliability of the internet access for any purpose. We are always entitled to allow additional users for WLAN operation, in whole or in part, temporarily or permanently, and to limit or exclude the tenant's access, if the connection is being used or has been used for abusive purposes, to the extent Appartamento Marc has to fear a claim for this and this cannot be prevented with reasonable effort within a reasonable time. Appartamento Marc expressly reserves the right to block access to certain pages or services over WLAN at its discretion and at any time (e.g., glorifying violence, pornographic, or paid sites). 


§ 11.1 Access Data Use of the WLAN is via access security. The access data (login and password) must not be passed on to third parties. If the guest wants to grant third parties access to the internet via WLAN, this is subject to our prior written consent and mandatory acceptance of the provisions of this user agreement by the third party, documented by signature and complete identity information. The guest undertakes to keep their access data secret. Appartamento Marc has the right to change access codes at any time. 

§ 11.2 Risks of WLAN Usage, Limitation of Liability The guest is advised that WLAN only provides access to the internet, and virus protection and firewall are not available. The data traffic generated using the WLAN occurs unencrypted. Data may, therefore, be visible to third parties. Appartamento Marc expressly points out that there is a risk that malware (e.g., viruses, trojans, worms, etc.) may enter the end device when using the WLAN. The use of the WLAN is at the guest's own risk. Appartamento Marc assumes no liability for damages to the tenant's digital media caused by the use of the internet access, unless the damages were caused by us and/or its vicarious agents intentionally or grossly negligently. 


§ 12 House Rules, General Rights, and Obligations 

(1) The guest is obliged to comply with the house rules. From [10:00 PM] to [6:00 AM], night rest is in effect. To avoid disturbance, TV and audio devices are to be set to room volume. 

(2) For the duration of the rental of the holiday apartment, the guest is obliged to keep windows (except tilted) and doors closed when leaving the holiday apartment. 

(3) Smoking is prohibited in the holiday apartment. In case of violations, a cleaning fee of up to [300 euros] may be charged. Smoking is only allowed on balconies and terraces. 

(4) The insertion and/or attachment of materials for decoration or similar in the holiday apartment are not allowed. The guest alone is liable for any inserted and/or attached decoration, etc. The guest is also obliged to compensate for damages caused by the insertion and/or attachment of decoration or similar. 

(5) Appartamento Marc has the right to access the holiday apartment at any time, especially in case of imminent danger. Due consideration must be given to the legitimate interests of the guest when exercising the right of access. We will inform the guest in advance about the exercise of the right of access, unless it is not reasonable or possible under the circumstances of the individual case. 

(6) Furthermore, the house rules apply in their currently valid version. These can be found on the website appartamentomarc.smoobu.net. 


§13 Jurisdiction 

For any disputes arising from the contractual relationship, the court of Bari has jurisdiction.


House rules

  1. WE ASK YOU TO RESPECT THE NIGHT TIMES AND SLEEPING HOURS FROM 10PM - 6AM
  2. YOU ARE REQUIRED TO ADHERE TO THE CHECK-IN TIME FROM 3PM AND CHECK-OUT BY 10:00AM. IN CASE YOU ARE EXCEEDING THESE BY MORE THAN 30 MINUTES, YOU WILL BE CHARGED HALF PRICE OF THE ROOM RATE. SHOULD YOU BE EXCEEDING MORE THAN 2 HOURS, THE FULL ROOM RATE WILL BE APPLIED
  3. ANY FORM OF SMOKING (VAPING, E-CIGARETTES, HOOKAH, DRUGS) INSIDE THE APARTMENT IS STRICTLY PROHIBITED
  4. PHOTO- & VIDEOGRAPHY FOR COMMERCIAL USE IS NOT ALLOWED
  5. ILLEGAL ACTIVTIES, IMMORAL AND UNETHICAL BEHAVIOUR WILL NOT BE TOLERATED
  6. PEOPLE WHO ARE LOCATED IN BARI OR WITHIN IT'S CATCHMENT AREA NEED TO CONTACT AND CONSULT THE LANDLORD AS SOON AS POSSIBLE AND IN ANY CASE PRIOR TO CHECK-IN
  7. PARTIES ARE STRICTLY PROHIBITED
  8. PEOPLE STAYING AT THE APARTMENT WHO HAVE NOT BEEN INCLUDED IN THE INITIAL BOOKING (ESPECIALLY OVERNIGHT), WILL RESULT IN ADDITIONAL 25€ PER COMMENCED DAY 
  9. UNAUTHORIZED CARRYING OF ANIMALS WILL RESULT IN INCREASED CLEANING COSTS OF APPROX. 50-200€ AND WILL BE SUBSUMED TO THE EXISTING CLEANING COSTS. SHOULD YOU RELY ON AN ASSISTANCE ANIMAL (SUCH AS GUIDE DOG), YOU ARE REQUIRED TO CONSULT THE LANDLORD PRIOR TO BOOKING
  10. DAMAGES DONE TO THE APARTMENT HAS TO BE NOTIFIED TO THE LANDLORD WITHOUT DELAY. GUESTS ARE LIABLE FOR DAMAGES, LOSSES OR UNUSUAL POLLUTION / WEAR AND TEAR.
  11. IT IS MANDATORY TO PAY THE LOCAL TOURIST TAXES PRIOR TO ARRIVAL. THEREFORE YOU WILL RECEIVE A PAYMENT LINK TO PAY THE TAXES. IT WILL BE 2€/PERSON/NIGHT BUT NOT MORE THAN 8€/PERSON/STAY.
  12. AT THE REQUEST OF THE LANDLORD, YOU HAVE TO PROVIDE PHOTOS OF VALID AND OFFICIALLY RECOGNIZED IDENTIFICATION DOCUMENTS OF ALL GUESTS PRIOR TO ARRIVAL. THIS DATA NEEDS TO BE PROVIDED DUE TO LEGAL REGULATIONS. THE DATA WILL BE STORED IN ORDER TO FULFILL THE REQUIREMENTS RELATED TO THE RENTAL. IF NECESSARY, SAME WILL BE FORWARDED TO THE RESPONSIBLE PARTIES.




*ANY VIOLATION OF THE MENTIONED REGULATIONS WILL RESULT IN A FINE STARTING AT 300€
